Drug Policy History
Revised January 2010
Alaska, California, Colorado, Hawaii, Maine, Michigan, Montana, Nevada, New Mexico, Oregon, Rhode Island, Vermont, and Washington have enacted laws allowing the use of marijuana as a so-called medicine.
Throughout 2009 we have tracked 84 pieces of pro-drug legislation across 28 states. Of those 84 bills we have already defeated 65, including “medical” marijuana bills in Alabama, Connecticut, Delaware, Illinois, Iowa, Missouri, Minnesota (by veto), New Hampshire (by veto), North Carolina, and South Dakota. We were also successful in defeating bills in Connecticut, New Hampshire, Rhode Island, Texas and Vermont that sought to decriminalize up to an ounce of marijuana. At this time, 12 pro-drug bills remain open in 5 states. Nine of those remaining open seek to legalize marijuana under the guise of medicine Of the 84 introduced bills, 7 have passed and they include bills in Rhode Island that will establish marijuana dispensaries, bills in both New Mexico and Maine and will study and regulate industrial hemp, and a bill in Maine that makes the possession of 2.5 ounces of marijuana a civil violation punishable by a fine.
During 2009, 32 states have proactively introduced 85 pieces of anti-drug legislation to strengthen efforts to combat drug use and abuse. 16 of these bills have already passed, and they include bills that will categorize Salvia as a controlled substance in Nebraska and South Dakota, establish a prescription drug monitoring program in Florida, create a new crime in North Dakota for defrauding a urine test, and generate a child abuse charge for having a minor in a meth house in New Mexico.

•2009 HB 2568 would create a felony for intentionally using a building for selling or distributing illegal drugs. Supported-Failed.
•2008 Petition I-04-2008 Taxation of Decriminalized Marijuana. Opposed-Failed to make ballot.
•2002 Proposition 203 sought to require the state to set up a distribution system for marijuana and removed prescription requirements. Opposed-Failed.

•1996 Proposition 200 The Drug Medical, Prevention, and Control Act of 1996, legalizes all schedule I drugs. Opposed-Passed.
ARKANSAS
•2009 SB 216 would require recipients of public assistance to undergo random drug testing for eligibility and requires those who fail testing to enter into substance abuse treatment program. Supported-Failed.
•2009 SB 38 sought to apply current alcohol and drug testing requirements for motor vehicles to operations of boats and personal watercraft. Supported-Passed.
•2009 SB 217 sought to include the presence of Schedule I and II substance as a violation of current DWI and underage DUI laws. Supported-Passed.

•2009 AB 1060 would address underage drinking by prohibiting the sale of alcoholic beverages at self-serve checkout kiosks used by retailers. Support-Open.
•2009 SJR 14 called on Congress to take specific actions aimed to safeguard the so-called medical use of marijuana in the state of California. Oppose-Open.
•2009 AB 390 sought to tax and regulate marijuana in a similar manner to alcohol. Oppose-Open.

FLORIDA
•Proposed initiative for 2010 ballot from group called People United for Medical Marijuana. Initiative seeks to legalize marijuana under the guise of medicine. The group is currently organizing volunteers to gather signatures to qualify for the 2010 ballot. Oppose-Open.
•2009 Jacksonville Beach Amendment seeks to make possession of less than 20 grams of marijuana a civil infraction instead of a criminal misdemeanor. The proposition is being led by the NORML Florida chapter and will need to collect 1,442 signatures from registered Jacksonville Beach voters to make the November 2010 ballot.
•2009 S 462 would establish a prescription drug monitoring program. Supported-Passed.
•2009 HB 201/ SB 802 sought to add 25% surtax to items that are sold as drug paraphernalia. Supported-Failed.
